Suit Dropped Against Famous Smoke Shop

Cigar bar and restaurant plans continue and construction well under way.

A suit filed against Forks Township and Famous Smoke Shop that could have stamped out plans for a cigar bar and restaurant has been dropped.

Donald Souders, the attorney representing Lehigh Valley Brennan Farms,  said both businesses had come to an agreement.

“Both parties are satisfied with whatever terms and agreements they have made,” said Souders.

He would not provide more details on what led to the suit being dropped.

In March, the business filed suit, claiming the municipality improperly granted approval to Cigar Works LLC, the principal for Famous Smoke Shop, for a conditional-use application and a liquor license transfer -- allowing for the construction of a 60,000-square-foot warehouse and restaurant facility at 90 Mort Drive.

At the time, Souders said his client, whose address is Kuebler Road and Mort Drive, believed more restrictions should have been placed on the conditional-use approval. His client also expressed concerns that future uses for the facility could attract bands, parties and other potentially loud events. Furthermore, the suit claimed that a conditional-use hearing was never held for the retail shop approval.
